SCOTT STEINER AND TNA SET TO FACE OFF IN COURT THIS WEEK
By Mike Johnson on 2012-10-23 10:37:47
A hearing is set for this Friday 10/26 in Nashville, TN in regard to the Scott Steiner vs. TNA lawsuit.
As noted here on PWInsider.com, TNA filed a lawsuit against Steiner citing breach of contract following his Twitter outbursts ripping on the promotion, Hulk Hogan, Eric Bischoff and others. Steiner filed a counter-suit, alleging that it was TNA that had breached their contract, citing their failure to provide accounting on royalties owed as well as non-payment of royalties.

TNA filed a motion to dismiss Steiner's suit, claiming that their contracts require a talent to inform them of a breach and allow 30 days to repair it before they attempt any legal maneuvers. TNA's argument is that since they were not made aware of any breach, Steiner cannot file suit.
And so it starts, the "he said, we said". Right now I have a feeling TNA may have the leg to stand on but be interesting to see how things unfold

The wording of that last part leads me to believe that TNA really weren't paying Scotty the money they owe him... No wonder he got so fuckin' pissed off. You don't fuck with a Freakzilla's money.

By the way, how can Steiner still be considered TNA talent when he's not even in the company anymore? This whole thing confuses me. The man has the right to speak his mind!

See I read the whole thing 3 times to make sure I understood what each side was saying.....I do agree with Steiner in that he should be able to get a proper documentation on what he's been paid. For it to say TNA says they never got a copy of the lawsuit makes me wonder what, if anything, TNA is trying to hide. I would think that as least for themselves, a wrestler should have a right to see that type of information.

I dont necessarily agree with the way he bashed TNA and such, and Iknow he was working for them in Ra Ka King (is that even still going?), but if he is, or was at the time of the bashing incident, then I see where that is where they can take a stance saying "he still worked for us and was still badmouthing us"

The whole thing is rather confusing

Isn't that like in seasons, rather than an ongoing thing like WWE? I think it's out of season right now.

Scott Steiner filed another lawsuit against TNA today in Nashville Chancery Court, according to The Nashville City Paper.

Steiner, in his latest lawsuit, alleges that TNA allowed a chemically incapacitated Jeff Hardy in the ring during a house show in Mount Pleasant, Michigan "while under the influence of alcohol and possibly drugs" according to the report. This time, Steiner claims TNA allowed wrestler Jeff Hardy to enter the ring during a match last year in Mount Pleasant, Mich., while under the influence of alcohol and possibly drugs.

Steiner, who is claiming nerve damage to his neck and back as well as an injury to his biceps due to Hardy's work while allegedly intoxicated, is alleging that "[TNA] knew or should have known that their agent, employee, representative, and/or servant was too incapacitated, intoxicated and/or under the influence of a controlled substance and should not have been allowed to enter the ring thus endangering the life, health, well being and safety of Scott Rechsteiner."

The Nashville City Paper cites that Hulk Hogan was responsible for "writing and approving the script" of the bout (which sounds off on paper, considering it was a house show).

Steiner is seeking $750,000 in damages.

Steiner and TNA have a hearing set on 11/30 in regard to TNA attempting to dismiss Steiner's first suit against the company, a counter-suit filed alleging they breached his contract for failing to give a proper accounting of royalties owed as well as failed to pay royalties. TNA's argument is that Steiner, contractually, has to give them 30 days' notice of the breach and to give them a chance to repair it before he can file for breach legally. That suit is in response to TNA suing Steiner for disparaging the company and its management, including Hulk Hogan, Dixie Carter and Eric Bischoff, via his Twitter account.

TNA has not yet been served with the lawsuit.

PWInsider.com will have more on the new lawsuit tomorrow

Hogan sure did piss the hell out of Steiner. I mean, he didn't even make any noise the first time TNA let him go. What did Hogan do to you, Freakzilla?

Anyways, I do remember the rumors of TNA letting Jeff Hardy wrestle wasted... So, it's possible Steiner isn't just lashing out here... Although, I seriously doubt he could even prove any of that... So... Eh...

That only proves TNA let Hardy wrestle when he was inebriated. It doesn't prove he actually hurt Scotty.

    It doesn't help.

Plus it is evidence that Jeff is an inept Junkie and has been known to work while under the influence of Drugs.

If they're smart they settle out of court

courtesy of pwinsider.com There was a couple different updates in the last 24 hours

    STEINER VS. TNA LAWSUIT UPDATE
By Mike Johnson on 2012-11-30 11:01:46
The hearing scheduled for this morning regarding Scott Steiner's lawsuit against TNA in Nashville was canceled late yesterday. No word yet as to why. There is no rescheduled date yet, so it may be the two sides are trying to negotiate some sort of settlement. We'll have more when we get it.
WHY TNA VS. STEINER HEARING WAS CALLED OFF TODAY
By Mike Johnson on 2012-11-30 17:24:55
It appears the court hearing scheduled for this morning between Scott Steiner and TNA was called off after Steiner's attorneys filed evidence on 11/26 that shot down TNA's legal argument in attempting to get the Steiner lawsuit dismissed.
TNA had argued that Steiner's breach of contract suit should be dismissed, noting that per the letter of their contract, Steiner needed to inform them of any potential breaches and give the company 30 days to attempt to repair the breach before attempting legal actions. So, since they had never been given the chance to repair the breach, Steiner could not try and take them to court.

On 11/26, Steiner's attorneys filed a notice with the court noting that the contractual terms ran from January 2011 through April 2011, so the contract would "not apply to the issues" being brought forth by Steiner.

With the hearing being canceled at the last minute, it would appear that material was a factor.

I guess TNA might be learning the hard way that despite how Steiner comes off on TV... the man really is no fool. I'm still rooting for him to win!

No shit. It's no exaggeration to say the man is a genius, even if he is a marble mouth. I'm sure he graduated from university with a fuckton of degrees.

No, I mean he is deceptively smart. He's on part with Schwarzenegger, and Schwarzenegger is at evil genius levels.

Yes. Research into Arnie before he made it big in Hollywood. He planned his career path into 'invading' Hollywood almost perfectly. He's also a master psychologist, it's how he won all those bodybuilding and strongman tournaments, by psyching out his opposition rather than outperforming them.

How do you psych out your competition in bodybuilding and strongman tourneys? Have a darker tan and put on more baby oil?

Get into their heads before each event to subconciously make them think they have no chance against him.

I don't know what is more fascinating, Steiner making TNA look like a bunch of dopes or Falcone knowing so much about Arnie

There are interviews with Steiner, where the interview stops and his way of speaking changes instantly. Sounds very intelligent.
